IRIS 2011-7:1/16 [CY] Digital Switch-over Regulated with Amending Radio and Television Law

The Republic of Cyprus is only days away from the digital switch-over on 1 July 2011 and is completing all necessary measures for a smooth transfer. Amendments of the Act on Radio and Television Stations L. 7(I)/1998 (Ο περί Ραδιοφωνικών και Τηλεοπτικών Σταθμών Νόμος), voted on by the House of Representatives in mid-April, providing for the procedures that radio and television organisations should follow in order to continue operation in the new environment. IRIS 2011-5:1/11 [CY] Radio Television Law to turn to AVMS and digital environment

An amendment to the Ο περί Ραδιοφωνικών και Τηλεοπτικών Σταθμών Νόμος (Law on Radio and Television Stations L. 7(I) /1998) is being studied, in an aim to extend its scope of application to cover audiovisual media services and respond to the new, digital environment. The amendment follows the adoption of an amending law incorporating provisions of the AVMS Directive into Cyprus legislation last December (see IRIS 2011-2/13). It appears also to be a necessary step in view of the digital switchover, set for 1 July 2011. A public consultation on the proposed changes is in progress (see IRIS 2010-3/13). According...

The announcement contains information on the rights, obligations and the role of the major actors, the operator of the commercial digital platform Velister...

IRIS 2011-4:1/14 [CY] Provisions of the Law on Retention of Telecommunications Data Declared Unconstitutional

The Supreme Court of the Republic of Cyprus decided on 1 February 2011 that Arts. 4 and 5 of the Law on the Retention of Telecommunications Data for the Investigation into Criminal Offences (L.183(I)2007) are in breach of the Constitution; moreover, the Law appears to go beyond the scope and goals of Directive 2006/24/EC on data retention. The Court verdict was issued in relation to petitions for a writ of certiorari by four persons against District Court orders that granted the police access to the claimants telephone communications data. The orders were issued according to Arts. 4 and 5 of L.183(I)2007,...

Cyprus amended its Law on Radio and Television Stations (L. 7(I)/1998) and the Cyprus Broadcasting Corporation Law (Ch. 300A) and harmonised the Republic's legislation with the European Directive 2010/13/EU on Audiovisual Media Services - codified version. The amending laws were published in the Official Gazette on 10 December 2010. Extensive amendments to various sections of the Law on Radio and Television Stations aimed at updating it in order to cover the broadcasting and audiovisual landscape, regulating not only the broadcasting sector but also Video-on-Demand (VOD) services. The terminology...
