On 7 November 2012, the President of the Slovak Republic signed the Act. No. 340/2012 Coll. on payments for public services provided by the Radio and Television of Slovakia (hereinafter “Act”). The legislative process thus having been completed, the Act came into effect on 1 January 2013. In recent months the Council for Broadcasting and Retransmission of the Slovak Republic (Council) has received complaints about an excessive amount of advertising within certain programmes of the major commercial TV broadcaster in Slovakia. In the case at hand an examination carried out by the monitoring department of the Council revealed two advertising breaks that together lasted exactly 12 minutes within the examined hour. On 10 July 2012 the Council for Broadcasting and Retransmission of the Slovak Republic (the Council) decided that the service tvsme, provided by the publisher of sme - one of two major Slovak mainstream broadsheet newspapers - constitutes an on-demand audiovisual media service (AVMS) and thus falls under the regulatory scope of the Council.
