The legal dispute over whether the broadcast of the film "Saving Private Ryan" was admissible (see IRIS 2003-4: 6 and IRIS 2002-8: 6) has been resolved. ProSieben Sat.1 Media AG (ProSieben) and the Medienanstalt BerlinBrandenburg (Berlin-Brandenburg Media Authority MABB) had taken their dispute over the admissibility under the youth protection law of the broadcast of an edited version of the film at 20.15 to a number of different courts. On 5 January 2003, ProSieben had then broadcast the film at 20.15 without the necessary permission, whereupon the MABB launched proceedings to fine the broadcaster.... |

On 28 May 2003, the Committee of Ministers of the Council of Europe adopted Recommendation Rec(2003)9 to member states on measures to promote the democratic and social contribution of digital broadcasting. In future, whenever the Consiliul Na tionalal al Audiovizualului (Romanian National Audiovisual Council - CNA) reprimands or sanctions a TV or radio broadcaster, the broadcaster concerned will be obliged, according to CNA Decision No. 52/2003, to provide its viewers or listeners with accurate, prompt information about the reason for and form of the punishment. In the case of TV broadcasters, a statement must be broadcast within 24 hours of the decision being announced by the CNA, at least three times between 6 pm and 10 pm and at least once in a main news bulletin. In a criminal law ruling of 31 January 2003, the Landgericht Düsseldorf (Düsseldorf District Court - LG Düsseldorf) assessed the rules governing the dissemination of pornography on the Internet with regard to the protection of minors.
