IRIS 2008-10:1/15 [FR] Graduated Response according to the Bill on “Creation and the Internet”

The French Government has presented a bill entitled “Creation and the Internet” as a solution to the threat to creation posed by unlawful downloading. Proposing the setting up of a system of “graduated response” which is intended to be dissuasive rather than repressive, the bill has given rise to considerable debate both in France and in Europe. Amendment 138 adopted by the European Parliament catalysed the fears expressed by the bill’s detractors (see IRIS 2008-10: 4). “Graduated response” refers to the method for warning and sanction that the new High Authority for the Broadcasting of Works and...

IRIS 2008-10:1/14 [FR] Development Plan for the Digital Economy

On 20 October 2008 the Government presented the 154 measures that make up its “2012 Digital France” plan, which aims at reducing the gap between France and its international competitors in this specific area. Noting that the digital economy is a vector for growth that has a lot of potential, the plan is based on three major democratic objectives, namely ensuring that everyone in France has access to broadband Internet, ensuring that France switches over to all-digital in the audiovisual sector before 30 November 2011 in keeping with the Giazzi Report submitted in September, and reducing the digital...

IRIS 2008-9:1/33 [FR] 2007 Balance Sheets of the Analog Television Channels

The Conseil Supérieur de l’Audiovisuel (national audiovisual regulatory authority – CSA) recently published the balance sheets of many channels, including the analog channels that most people in France still receive. Global and comparative analysis of the balance sheets shows that the channels are generally quite respectful of their obligations, in terms of both ethics and quantity, such as production quotas and obligations. The CSA noted however that all the public-sector channels have spontaneously exceeded these obligations by a wide margin. There has been a general falling-back in the offer...

IRIS 2008-9:1/15 [FR] State of Progress on the Reform of the French Audiovisual Scene

After the French President announced on 8 January 2008 that he wanted to abolish all advertising on public-sector television channels, the Copé Commission brought together a number of parliamentarians and professionals to discuss the issue. After four months of hearings, the Commission has delivered its report, advocating the gradual abolition of advertising on public-sector television channels after 8 p.m., starting in 2009. Added to these proposals are a number of desires on the part of the President, resulting in the start of the reform. This summer, the Act on modernising the economy amended...

IRIS 2008-9:1/14 [FR] Strict CSA Deliberation against Programmes for Young Children

On the basis of an opinion delivered on 16 April 2008 by the Ministry of Health on the impact of television channels on very young children, the Conseil Supérieur de l’Audiovisuel (national audiovisual regulatory authority – CSA), in compliance with the mission to protect children and adolescents conferred on it by Articles 1 and 15 of the Act of 30 September 1986, delivered a deliberation on 22 July 2008 aimed at protecting children under the age of three years from the effects of television. Two experts’ reports were the inspiration for the scientific opinion of the Ministry of Health against...
