IRIS 2002-9:1/27 [CZ] Tobacco Advertising Ban

Members of the Czech Parliament have tabled a Bill proposing a complete ban on tobacco advertising. Preparations for the latest amendment to the Act on the Regulation of Advertising have already caused disputes with the tobacco industry lobby. According to EC Directive 98/43/EC of 6 July 1998 on the approximation of the laws, regulations and administrative provisions of the Member States relating to the advertising and sponsorship of tobacco products, tobacco advertising should have been banned completely back in 2000. However, in its ruling of 5 October 2000, the European Court of Justice (ECJ)...

The Parliament of the Czech Republic has passed an amendment to the Czech Radio Act, based on the amendment to the Czech Television Act (see IRIS 2001-7: 8). In terms of organisation, the Director General of Czech radio will continue to be elected by the members of the Czech Radio Council, which for its part will still be elected by the lower house of Parliament. After adopting the Electronic Signatures Act in June 2000, the Czech government has set out, in Resolution no. 304/2001, a number of conditions for the practical implementation of the Act. The government is keen to make its electronic legal and business dealings legally binding in order to safeguard the protection of basic rights. According to the Resolution, the State administrative authorities are obliged to accept legal documents in electronic form. If registered electronic signatures are used in administrative procedures, signed electronic documents should be legally binding. The relevant...

IRIS 2002-1:1/28 [CZ] Validity of “Lustration Act” Confirmed

On 5 December 2001, the Constitutional Court of the Czech Republic decided that the so-called "Lustration Act" did not contravene the Constitution, and therefore could remain in force. The Act prohibits persons who were linked to the Communist regime from performing important civil service functions, particularly in public-service broadcasting. The Court based its decision, inter alia, on the caselaw of the European Court of Human Rights. A democracy should be allowed to defend itself. Moreover, it was not that long since the Communist regime had been overthrown. These considerations outweighed...
