IRIS 2008-1:1/10 [CZ] Amendment to the Copyright Act

The parliament of the Czech Republic is currently debating an amendment to the Copyright Act. This relates to the copyright issues involved in the supply of radio and television programmes in hotels and to the freedom to provide services. The issue of copyright in connection with the supply of radio and television programmes in hotels has been the subject of controversy in the Czech Republic for many years. The European Court of Justice considered it some time ago (C-306/05, SGAE v. Rafael Hoteles; see IRIS 2007-2: 3). In its judgment of 7 December 2006, it classified the distribution of signals...

IRIS 2007-10:1/11 [CZ] Amendment of Broadcasting Law with a View to Digitisation Approved

In view of the impasse in the Czech Republic with regard to the switchover in broadcasting transmission from analogue to digital (see IRIS 2007-5: 5), it became clear that a new law on the digitisation of television would be necessary. The existing law was no longer suited to the needs of digital broadcasting. The bill was drafted by the government and passed by the Chamber of Representatives on 27 September 2007 and must now go before the Senate and be counter-signed by the President of the Republic. No further major modifications are expected. The deadlines, conditions and procedures for the...

In July 2007, the Parliament of the Czech Republic approved law No. 160/2007 Coll. implementing the EC Regulation No. 2006/2004. The Regulation sets out two objectives: (1) to facilitate co-operation among public authorities responsible for the enforcement of...

IRIS 2007-7:1/10 [CZ] Incorrect implementation of the Tobacco Advertising Directive

In the Czech Republic, advertising is regulated by Act No. 40/1995 (Advertising Regulation Act), according to which, subject to a few exceptions, tobacco advertising and sponsorship by tobacco products/companies is generally prohibited (see IRIS 2002-9: 14 and IRIS 2003-6: 12). Such advertising is only allowed in the press and other printed matter that is exclusively intended for persons working in the tobacco trade and in publications printed and published in third countries, provided that they are not primarily intended for the Community market. The Act does not exclude the possibility of tobacco...

IRIS 2007-6:1/34 European Commission: State Aid for Czech Film Production Approved

The European Commission approved with its decision C(2007)3280 of 29 June 2007 the state aid provided by the Czech Republic for the production of audiovisual programmes (Eurovize). The Czech Republic had duly notified the Commission of the measure, the principal aim of which is to inform the Czech general public via audiovisual works how public institutions (such as Czech ministries and the European Investment Bank), Czech municipalities and other state organisations contribute to the preservation of the cultural heritage and the development of tourism in the Czech Republic. Individual aid is granted...
