IRIS 2009-8:1/10 [CZ] Arbitration Proceedings Concerning Broadcaster TV3

The arbitration proceedings between the Czech Republic and the Luxembourg-based company European Media Ventures concerning the broadcaster TV3, conducted by the court of arbitration in London, were decided in favour of the Czech Republic. The proceedings were opened in 2005, although the case itself had begun before that. In 1999, a sole trader was granted a licence to broadcast regional television programmes in Prague and Hradec Králové. When he started broadcasting, he was supported by the company EMV. In principle, a broadcasting licence may not be transferred to another person. However, it...

IRIS 2009-8:1/9 [CZ] Broadcasting Act Amended

The Czech Parliament has adopted an amendment to the Broadcasting Act, which is known to the public as the "digital radio amendment" and is designed to support radio digitisation. In fact, however, the amendment barely deals with the subject of digitisation and it remains largely unclear what radio digitisation will be like. The amendment relaxes media concentration rules in the radio sector and redefines the concept of national radio stations. The latter are now defined as channels that can be received by at least 80% of the population, whereas previously the figure was 70%. Regional radio broadcasters...

IRIS 2009-7:1/8 [CZ] Election Campaign of Nationalist Parties

Nationalist parties in the Czech Republic committed a number of infringements during the recent European Parliament election campaign. Candidates included members of the nationalist Workers' Party (Dělnická strana) and the National Party (Národní strana). Both parties submitted election spots to be transmitted on Czech Television and Czech Radio, the content of which provoked fierce reactions from the government, Czech Television and Czech Radio. One of the TV spots showed images of Roma families with the words "Stop Black Racism", "We don't want black racists among us" and "Stop Favouring Gypsies"....

IRIS 2009-6:1/11 [CZ] Administrative Court Bans Advertising of Dietary Supplement

The Supreme Administrative Court of the Czech Republic banned advertising of a dietary supplement in a ruling of 29 January 2009. The Czech Advertising Regulations Act prohibits advertising that claims that dietary supplements are able to cure or prevent human illnesses. Liability for advertising lies with the contractor. The Broadcasting Council is responsible for regulating television advertising. The company Mediarex Communications and Consulting s.r.o. had commissioned television advertising of the dietary supplement Preventan akut . In the advertising, the product was described as having...

IRIS 2009-5:1/15 [CZ] Advertising Logo Sponsorship

A number of Czech television channels have recently broadcast several unusual commercial inserts. Immediately before the commercial separator was shown, the logo of a sponsor appeared, identified as the sponsor of the commercial separator. The Broadcasting Council considered this to be a breach of the provisions of the Broadcasting Act on the separation of advertising and programme material. Advertising must be clearly identifiable and separated from other programme elements by optical means on television and acoustic means on radio. Sponsorship, on the other hand, is the contribution of a natural...
