This case emerged after a lawsuit was lodged by the Mostar-based cable operator MONET CATV with the aim of annulling a decision issued by the Council of the Communications Regulatory Agency (RAK). The Council had confirmed an initial RAK decision from 2005 whereby a financial penalty in the amount of BAM 18,000 (around EUR 9,000) was imposed on MONET CATV due to unauthorised distribution of the Zagreb-based commercial network’s Nova TV channel. The Council of the Communications Regulatory Agency (RAK), at its September session, has decided to hold public consultations on draft changes and amendments to the Broadcasting Code of Practice. The original version of the Broadcasting Code of Practice was adopted in 1998 and has since been changed and amended in 1999, 2000, 2001 and 2004. The new draft brings substantial changes in line with the basic principles of the EU with regard to the broadcasting sector. The Regulatorna agencija za komunikacije (Communications Regulatory Agency - RAK) of Bosnia and Herzegovina, responsible for the broadcasting and telecommunications sectors in the country, has issued written warnings to both public and commercial broadcasters due to the violation of Articles 3 and 8 of the Code on Advertising and Sponsorship for the broadcast of the advertising clip “Royal”. The Advertising and Sponsorship Code forbids advertising and teleshopping related to tobacco products as well as deceptive advertising. The Communications Regulatory Agency ( Regulatorna agencija za komunikacije - RAK) recently published its research on the market of Internet Service Providers (ISPs) in Bosnia and Herzegovina in 2006. The research questionnaire results were based on the sample of 43 licensed ISPs, showing that in 2006 in Bosnia and Herzegovina there were 237,660 Internet subscribers. An Internet user is, according to the International Telecommunications Union's (ITU) definition, any person aged 16-74 using the Internet during the year.
