IRIS 2008-2:1/23 [LV] New Draft Film Law Proposed

The Ministry of Culture of Latvia has drafted and proposed a new Film Law. So far there has not been any field-specific law in Latvia in relation to the film industry (with the exception of the Regulations on the Distribution of Films, adopted in 2001). The draft Film Law proposes to ensure the support policy for the national film industry, to promote the production and distribution of national films, as well as the preservation and protection of the film heritage. To achieve this goal, the law sets out the financing principles of films, the fundamental principles of the support policy, the governance...

IRIS 2007-10:1/27 [LV] Administrative Court Requires National Broadcasting Council to Provide Substantive Responses to Complaints

On 3 October 2007 the Administratīvā rajona tiesa (Administrative County Court) of the Republic of Latvia adopted a judgement, in which it recognised an action of the National Broadcasting Council as being inconsistent with the law, and requested that the Council review the substance of the matter. The judgement is particularly interesting because for the first time the way in which the Council should react and respond to complaints of the public with respect to activities of broadcasting companies has been discussed. On 4 January 2007, the Regional Administrative Court of Latvia ruled that a decision of the Nacionālā radio un televīzijas padome (National Broadcasting Council - NRTP) on the issuing of a broadcasting licence did not conform to the law. Although the specific decision concerned a permit for radio broadcasting, the principles pointed out by the court equally apply to television broadcasting licences. The issuing of all kinds of broadcasting licences in Latvia is carried out by the National Broadcasting Council in accordance with the Radio and Television Law. The law requires a special competition...

IRIS 2007-1:1/23 [LV] Constitutional Court Affirms the Independence of the National Broadcasting Council

On 16 October 2006 the Constitutional Court of the Republic of Latvia ( Constitutions tiesa ) adopted the judgement on the constitutionality of the independent status of the National Broadcasting Council. The judgement was adopted following the review of the application submitted by twenty members of the Latvian Parliament ( Saeima ). The members of the Parliament disputed certain provisions of the Radio and Television Act ( Radio un televīzijas likums ) adopted on 24 August 1995, claiming that they are contrary to the Constitution ( Satversme ) of the Republic of Latvia, namely, to Article 58...
